HAPPY LEMON REWARDS PROGRAM TERMS

Please read these Happy Lemon Rewards Program Terms carefully. By joining or participating in the Program, you agree to these Terms, the Happy Lemon Terms of Use, and the Happy Lemon Privacy Policy, each incorporated by reference. If there is a conflict, these Terms control only with respect to the Program. |
The Happy Lemon Rewards Program (the “Program”) is offered by Yummy-town USA LLC, doing business as Happy Lemon (“Happy Lemon,” “we,” “us,” or “our”). The Program is available through the Happy Lemon mobile application (the “App”) and at participating Happy Lemon locations.
To participate, you must download the App, create a Program account, and comply with these Terms. You must be at least 13 years old. If you are under the age of majority where you live, you may participate only with the permission and supervision of a parent or legal guardian. Users under 18 may not make payments through the App.
Members earn one (1) Lemon for every seven dollars ($7.00) spent on qualifying purchases:
in person at a participating Happy Lemon location; or through the Happy Lemon App.
Lemons are not earned on gift card purchases or purchases made through third-party delivery platforms. Additional exclusions or promotional earning rules may be disclosed in the App or at participating locations.
In-store purchases. You must present the QR code associated with your Program account before the qualifying transaction is completed. Cashiers are not required to remind you. Lemons cannot be added retroactively after a transaction is completed.
App purchases. Lemons earned on qualifying purchases made through the App will be credited automatically to your Program account.
Ten (10) Lemons may be redeemed for one eligible drink, subject to availability and any exclusions disclosed in the App or at the participating location.
Lemons may be redeemed only through the App or at participating Happy Lemon locations. A reward may not be combined with other offers unless expressly permitted. Applicable taxes, fees, add-ons, or customizations must be paid separately unless otherwise stated.
Each Lemon expires one (1) year after the date it is credited to your Program account.
Lemons and rewards have no cash value and may not be transferred, sold, exchanged, or redeemed for cash, except where required by law.
Once redeemed, Lemons and rewards are not refundable or returnable, except where required by law.
Lemons may be earned and redeemed only at participating Happy Lemon locations. Participation may vary by location.
You must provide accurate and current account information and keep your login credentials confidential. You are responsible for activity occurring through your account. Please notify us promptly if you believe your account has been accessed or used without authorization.
Program-related communications may be sent by email, SMS, or push notification as permitted by law and based on your communication preferences. Marketing preferences may be changed in the App or through the method provided in the applicable message. Transactional and account-related messages may still be sent when necessary to administer the Program.
6. Adjustments, Misuse, and Account Termination
We may correct a Program account if Lemons or rewards were credited, deducted, or redeemed in error. We may suspend or terminate an account, remove Lemons or rewards, or restrict Program participation if we reasonably determine that an account has been used in an unauthorized, fraudulent, abusive, or unlawful manner, or in violation of these Terms or the Terms of Use.
Lemons and rewards associated with a suspended or terminated account may be forfeited to the extent permitted by law.
We may modify these Terms or change, suspend, or discontinue all or any part of the Program, including earning rates, redemption requirements, eligible rewards, expiration rules, participating locations, or Program features, to the extent permitted by applicable law. Material changes will be communicated by updating the “Last updated” date, posting notice in the App or on our website, or through another legally permitted method.
Your continued participation after revised Terms become effective constitutes acceptance of the revised Terms. If you do not agree to a change, you must stop participating in the Program.
THE PROGRAM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HAPPY LEMON DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, RELATING TO THE PROGRAM, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HAPPY LEMON AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE PROGRAM, THESE TERMS, OR YOUR PARTICIPATION IN THE PROGRAM. HAPPY LEMON’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE PROGRAM WILL NOT EXCEED THE VALUE OF THE UNUSED REWARDS IN YOUR PROGRAM ACCOUNT AT THE TIME THE CLAIM AROSE.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of certain damages. In those jurisdictions, the foregoing exclusions and limitations apply only to the maximum extent permitted by applicable law. Your participation in the Program is also subject to the disclaimers, limitations of liability, indemnification provisions, dispute resolution provisions, and other applicable terms contained in the Happy Lemon Terms of Use.
Except as expressly stated in these Terms, your participation in the Program is governed by the Happy Lemon Terms of Use and Privacy Policy, each of which is incorporated into these Terms by reference and is available on the Happy Lemon website. If these Terms conflict with the Terms of Use solely with respect to the Program, these Terms will control.
